The above specifications are the typical specifications as contractually agreed. If actual net calorific value (as received) of coal varies from 5100 kcal/kg (net as received), the price for the cargo of coal shall be adjusted by using the following formula

8.	Loading Terms:

9.	W/S/A:       loadport results issued by Geoservices Indonesia  to be final and binding for settlement.  
  
10.	Payment:  by 100% irrevocable fully workable LC at sight opened by a 1st class bank agreeable by the Seller that must be opended 10 ays prior to commencement of respective load port laycan.
 
11.	Law/arbitration:  English Law shall apply and arbitration in Hong Kong 
 
12.	Others:     other terms and conditions to be mutually agreed.
